1. Foreword

The website (hereinafter the “Website”) that you are navigating places great emphasis on the privacy of its visitors (hereinafter the “Visitors”), in full compliance with the provisions of Directive 95/46 EC and Italian legislative Decree 196/2003 (the so-called “Codice della Privacy”- Privacy Code). You will find here all the rules and procedures which have been carefully identified, chosen and adopted by ELLEN CONDE di Elena Nastachena Sas (hereinafter “ELLEN CONDE ”) in order to ensure the best possible protection and confidentiality of the personal data provided by Website Visitors during the collection, management and safekeeping of such data. 2. Privacy

In accordance with Art. 13 of the Italian Privacy Code, ELLEN CONDE gives detailed information to Visitors who wish to navigate the pages of its Website.

3. Processing of data: place and method

Data collected during the Website visit, which start from the home page address, are processed by ELLEN CONDE with electronic equipment and, in all cases, with automatic tools, digital archives and electronic, telematic and/or manual media, only for the time that is strictly necessary to achieve the goals for which they have been collected. In all cases, the processing of the Visitors’ personal data by ELLEN CONDE is carried out in such a way that ensures their safety and confidentiality, in full compliance with the existing and applicable laws. Specific safety measures are also implemented to avoid any loss of the Visitors’ personal data or their illegal or inappropriate use. ELLEN CONDE also uses several advanced technological systems in order to identify and rectify any unusual activity, and in order to monitor contents to prevent said activities (such as, for instance, spam activity).

4. Type of processed data

Navigation data

During the normal execution of the IT systems and software procedures required for the proper operation of the Website, ELLEN CONDE acquires some personal data of Visitors, whose transmission is implicit in the use of Internet communication protocols. The acquired information is not collected to the purpose of associating it to identified Visitors. However, processing and/or combining said information with data owned by third parties, or by aggregation with the data voluntarily provided by the User (see following paragraph), it may allow for the identification of Visitors (provided that prior express request has been made to the Judicial Authority). These types of data include, by way of example and not limited to, the IP addresses or domain names of computers used by Visitors to connect to the Website; the url addresses of requested resources; the time of the request; the method used to submit the request to the server; the size of the file obtained in response; the numerical code which identifies the status of the server response and other parameters related to the operating system and the IT environment of the Visitor.

Commonly used collection methods include, by way of example and not limited to, “Web server registers/IP addresses”, “cookies” and “beacons”.

“IP addresses” are the numbers assigned to each computer when connecting to the Internet and allow computers and servers to communicate and recognize each other in order to exchange Web protocol data. Such data are collected and analyzed (also by commercial partners and/or suppliers) to evaluate the Website navigation and its performances.

“Cookies” are information which is automatically saved by the computer when accessing specific websites, so as to uniquely identify the used browser. These data also help ELLEN CONDE to improve your navigation of the Website and evaluate its performances. However, all browsers allow users to disable cookies or be alerted when one is received. In this case, some pages of our Website may not display or work correctly.

Cookies are not used to transfer personal information and no permanent cookies of any kind are used. Also, no Visitor tracking system is used.

The use of so-called session cookies – which are not permanently stored on the Visitor’s computer and disappear when the browser is closed – is strictly limited to the transmission of the session identifying data needed to ensure a safe and efficient navigation of the Website.

Cookies do not store data such as name, address, etc. Cookies are solely used to register the Website parts which are accessed by the Visitor and for how long. This allows ELLEN CONDE not only to identify the most accessible parts of the Website, but also to improve the overall quality of the Website. In any case, the browser can be used to block, limit or delete cookies.

“Beacons”, also known as “clear GIFs” or “action tags”, are used in some pages of our Website or in specific e-mail messages. Beacons usually measure the number of Visitors of the Website or the number of Visitors which access some key elements of the Website.

These technologies do not automatically collect any personal identification data which may concern you. The collected data – which build the log register – are used by ELLEN CONDE to the only purpose of obtaining anonymous statistical information on the use of the Website and to monitor its proper operation.

Data voluntarily provided by the Visitor

Most of the pages and information contained in our Website can be accessed by the Visitor without any identification. However, for some limited sections of our Website it may be necessary to register, i.e. fill out some fields with personal data (the “Personal Data”). The optional, express and voluntary submission of Personal Data by the Visitor to ELLEN CONDE implies the subsequent acquisition of such data by ELLEN CONDE.

In the same way, ELLEN CONDE may acquire some Personal Data if the Visitor decides to send them with e-mail messages.

Our Website is targeted at adult Visitors. We do not voluntarily collect identification data of minors.

5. Mandatory or optional nature of the submission of data

Without prejudice to the above paragraph on Navigation Data, Visitors are free to provide their Personal Data when required and/or which they wish to send. In case of accidental provision of Personal Data, Visitors enjoy the rights set forth by Art. 7 of Italian Legislative Decree 196/2003, as illustrated in the following sections.

6. Goals and methods of data processing

All Personal Data provided by Visitors to ELLEN CONDE during the navigation of the Website and/or when using the Website shall be processed by ELLEN CONDE, as Data Controller, for the management of any claims and disputes. Data voluntarily provided by the Visitor shall be solely used for purposes tightly connected to such data, such as – including but not limited to – to carry out studies, market research, statistical research, send advertising and/or information materials on ELLEN CONDE activities, press conferences and initiatives, and send commercial information. Personal Data are processed with automatic tools and only for the time that is strictly necessary to achieve the goals for which they have been collected.

7. Safety of information

Specific safety measures are implemented to prevent the loss of the Visitors’ Personal Data, illegal or improper use and non authorized access. To this purpose, ELLEN CONDE uses safety technologies and procedures to protect Visitors and their Personal Data against improper use, loss or destruction, in compliance with the provisions of Legislative Decree 196/2003. Personal Data shall only be accessible to the appointed Persons in Charge of the Processing who actually need to use such Personal Data.

8. Third parties who may get to know the Visitors’ Personal Data / Visitors’ Personal Data transfer abroad

ELLEN CONDE may ask third parties to carry out some processing activities concerning Visitors’ Personal Data, as third parties may be assigned tasks (or part of them) which are necessary or functional for the provision of the Website services. ELLEN CONDE may also share the Visitors’ Personal Data with service suppliers with which ELLEN CONDE has contractual agreements and which cooperate to its business activities.

In these cases, such third parties shall be appointed as Data Processors or Persons in Charge of the Processing, in compliance with the provisions of the Italian Privacy Code. In addition, such third parties will be informed in particular on the adoption of minimum safety measures, in order to ensure the confidentiality and safety of the Visitors’ data.

Visitors’ data (including the IP address) may be communicated to the Judicial Authority, administrative authorities or other public bodies entitled to ask for them, when required by the law.
